These terms govern every hookah equipment rental booked through smokyfi. At booking you also sign a rental agreement and a platform waiver for your specific reservation; together, those documents and this policy are the full rental contract.
You must be at least 21 years old to rent hookah equipment or receive hookah tobacco through smokyfi. Federal law (Tobacco 21) and Florida law prohibit the sale or delivery of tobacco products, including hookah tobacco, to anyone under 21.
Your age is verified when you book, and you must present valid government photo ID at handover or delivery. If you cannot prove you are 21 or older, the vendor must refuse the rental. One account per person, accounts cannot be transferred, and the person who books is the person responsible for the equipment.
Hookahs are expensive and fragile, so rentals carry a refundable security deposit set by the vendor for that hookah, based on the hookah's price. Where a deposit applies, it is authorized as a hold on your payment card at booking. A hold is not a charge: no money moves unless a valid damage or loss claim is approved under Section 5.
Handover and return are documented with time-stamped photos taken in the app. The handover photos are the baseline, and any wear visible in them cannot later be claimed as damage you caused.
Normal wear is never charged: minor surface scuffs from handling, light water spotting that cleans off, normal grommet compression, and minor cosmetic patina from heat.
Chargeable damage includes: cracked or broken glass, dented or bent stems or trays, scorched or melted hoses or grommets, missing parts such as mouthpieces, tongs, bowls or heat management devices, burn or melt marks, and anything that makes the hookah unsafe or unusable.
If equipment is lost, stolen or never returned, you are liable up to the full deposit amount, and the vendor may pursue documented replacement value beyond the deposit through the dispute process.
The vendor is solely responsible for cleaning and sanitizing all equipment between rentals, and builds that cost into their pricing. No cleaning fee may be charged to you at booking, at return, or as part of a damage claim, under any circumstances.
Your part is simple: return the equipment emptied of water and tobacco residue, with loose debris removed. Ordinary use residue is not damage. If equipment arrives dirty, photograph it at handover and report it in the app; you may decline the handover without penalty.
Disputed claims go to smokyfi review. Both sides submit their photos and statements, and smokyfi issues a written determination, typically within 7 business days. The rental agreement is governed by Florida law. Both sides agree to try the platform process first and in good faith before other remedies. Filing a payment chargeback while a good-faith dispute is pending is a breach of this policy and may lead to account suspension.
Equipment must be returned by the date, time and method in your booking confirmation. A short grace period applies after the deadline. After that, a daily late fee accrues at the rate disclosed on your listing and booking, capped as stated there, and is deducted from the deposit hold only after you are notified. Equipment not returned within the no-return window stated in your booking is treated as lost under Section 3.
Hookah tobacco contains nicotine, an addictive chemical, and smoking exposes you to carcinogens and carbon monoxide. Charcoal produces extreme heat and carbon monoxide: use it only in ventilated spaces and never leave lit coals unattended. By renting, you acknowledge these inherent risks, as set out in the platform waiver you sign at booking. Nothing in this policy reduces the vendor's duty to supply clean, safe, properly working equipment.
smokyfi may update this policy. Material changes apply only to bookings made after the updated version takes effect; the version in force when you booked governs your rental.
